These Terms and Conditions of Service (“Terms”) govern your access to and use of the Buckstrybe mobile application (“App”) and all related services (collectively, the “Services”) provided by Buckstrybe (“we,” “us,” or “our”), a company registered in England and Wales.

By downloading, installing, accessing, or using our App and Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our App or Services.

  1. Definitions
  • App: The Buckstrybe mobile application.
  • Credit Visibility Score: Our proprietary AI-powered score that tracks and assesses your creditworthiness based on informal financial activities.
  • Informal Transactions: Financial activities not typically recognised by traditional credit systems, such including but not limited to rent payments, board money, rotational savings and credit schemes (money cycles), and informal peer-to-peer lending.
  • Open Banking: A secure, regulated framework that allows you to share your financial data with third-party providers like Buckstrybe, with your explicit consent.
  • P2P Marketplace: The feature within the App that facilitates lending and borrowing directly between Buckstrybe users, typically within their network of phone contacts.
  • Services: All features, functionalities, and content provided through the Buckstrybe App, including Credit Visibility Score generation, informal transaction tracking, P2P Marketplace, and reporting to Credit Reference Agencies.
  • User/You: Any individual who downloads, installs, accesses, or uses the Buckstrybe App and Services.
  1. Eligibility and Account Registration

2.1 Eligibility: To use our Services, you must be: * At least 18 years old. * A resident of the United Kingdom. * Capable of entering into a legally binding agreement.

2.2 Account Registration: To access most of our Services, you will need to create an account. You agree to: * Provide accurate, current, and complete information during the registration process. * Maintain and promptly update your account information to keep it accurate, current, and complete. * Maintain the confidentiality of your account password and notify us immediately of any unauthorised use of your account. * Be solely responsible for all activities that occur under your account.

  1. Our Services

3.1 Informal Transaction Recognition and Credit Visibility Score: * Buckstrybe recognises and validates your Informal Transactions by securely accessing your bank activity via Open Banking. * Our AI-powered system analyses patterns from your verified Informal Transactions to generate a Credit Visibility Score, reflecting your financial activity and responsibility. * The Credit Visibility Score is a proprietary assessment by Buckstrybe and is not a traditional credit score issued by Credit Reference Agencies themselves. It is intended to increase your visibility to lenders and improve your financial inclusion.

3.2 Open Banking Integration: * Our Services utilise Open Banking technology to securely access your financial transaction data from your bank account(s). * Your explicit consent is required to link your bank account(s) and for us to access your data. This consent is managed through our regulated Open Banking providers. * You can revoke your Open Banking consent at any time through your bank or through the Buckstrybe App settings. Revoking consent will affect our ability to track your Informal Transactions and update your Credit Visibility Score. * Your financial data is handled with bank-grade security and encryption. We will never sell your personal financial data.

3.3 P2P Marketplace: * The P2P Marketplace allows you to lend money to or borrow money from individuals within your phone contacts whom you know and trust, or within the wider Buckstrybe community. * Buckstrybe is a facilitator only: We provide the platform, tracking, and reporting tools. We are NOT a lender, borrower, financial advisor, or guarantor of any P2P loan. * Risks: You acknowledge that lending or borrowing money carries inherent risks, including the risk of non-repayment. Buckstrybe does not guarantee repayment of any loans facilitated through its P2P Marketplace. * Your Responsibilities: You are solely responsible for: * Assessing the creditworthiness of the individual you are lending to or borrowing from. * Agreeing on all terms of the loan (e.g., amount, interest, repayment schedule) directly with the other party. * Ensuring the accuracy of any information you provide or rely upon in a P2P transaction. * Tracking and enforcing your own repayment terms. * Tracking and Reporting: We track the payments made through the P2P Marketplace for the purpose of contributing to your Credit Visibility Score. Timely repayments build trust and credit visibility within the App. * Privacy in P2P: When you sync your contacts, only you can see your synced contacts within the App. Transaction details between specific parties will be visible only to those parties.

3.4 Reporting to Credit Reference Agencies (CRAs): * Where possible and with your appropriate consent, Buckstrybe may report your Credit Visibility Score and certain verified payment patterns (e.g., consistent rent payments, money cycle contributions, P2P loan repayments) to Credit Reference Agencies (CRAs) in the UK (e.g., Experian, Equifax, TransUnion). * You acknowledge that CRAs will use this information in accordance with their own privacy policies and may share it with lenders and other organisations as part of traditional credit assessments. * Buckstrybe is not responsible for how CRAs use or interpret the data we provide, nor for any decisions made by third-party lenders based on information from CRAs.

3.5 Credit Score Monitoring: * Our App allows you to track the progress of your Credit Visibility Score and understand how your informal transactions contribute to it.

  1. User Responsibilities and Conduct

4.1 Lawful Use: You agree to use the App and Services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the App.

4.2 Accurate Information: You warrant that all information you provide to Buckstrybe, including during registration and connecting bank accounts, is true, accurate, current, and complete.

4.3 Prohibited Activities: You agree not to: * Use the App for any fraudulent or illegal activity. * Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity. * Attempt to gain unauthorised access to the App, other user accounts, or computer systems or networks connected to the App. * Interfere with or disrupt the integrity or performance of the App or data contained therein. * Use the App to engage in any activity that could be considered a “loan shark” activity or lead to “debt traps.” * Circumvent or attempt to circumvent any security features of the App. * Harvest or collect information about other users without their express consent.

4.4 Content Standards: If the App allows for user-generated content (e.g., community discussions), you agree that any content you post will be: * Accurate (where it states facts). * Genuinely held (where it states opinions). * Comply with applicable law in the UK and in any country from which it is posted. * Not be defamatory, obscene, offensive, hateful, inflammatory, or promote discrimination. * Not infringe any copyright, database right, or trademark of any other person.

  1. Fees and Payments

5.1 Subscription Fee: Access to the full range of Buckstrybe Services, including informal transaction tracking, Credit Visibility Score generation, P2P Marketplace functionality, and reporting to Credit Reference Agencies, requires a monthly subscription fee of £4 (four British Pounds). This fee will be charged to you on a recurring monthly basis.

5.2 Payment Method: You must provide a valid and current payment method (e.g., debit card, credit card) when you subscribe to our Services. By providing a payment method, you authorise us to charge the monthly subscription fee to that payment method.

5.3 Billing Cycle: The subscription fee will be charged approximately on the same day of each month, corresponding to the date you activated your subscription. In some cases, the billing date may change, for example, if your payment method has not successfully settled or if your paid subscription began on a day not contained in a given month.

5.4 Failed Payments: If a payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the Services until we have successfully charged a valid payment method. We reserve the right to retry payments multiple times.

5.5 Cancellation: You may cancel your monthly subscription at any time through your account settings in the App. Cancellation will take effect at the end of your current billing cycle, meaning you will continue to have access to the Services until then, and no further charges will be made. No refunds will be provided for any partial subscription period or unused services.

5.6 Changes to Fees: We reserve the right to change our subscription fees from time to time. Any changes to the fees will be communicated to you with reasonable notice (e.g., at least 30 days) prior to the new fees taking effect. Your continued use of the Services after the effective date of the new fees will constitute your acceptance of the revised charges. If you do not agree to the new fees, you must cancel your subscription before they become effective.

 

  1. Intellectual Property Rights

6.1 Ownership: The App, its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Buckstrybe, its licensors, or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2 Licence: You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use, subject to these Terms.

6.3 Restrictions: You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as generally and ordinarily permitted through the App’s functionalities.

  1. Disclaimers and Limitation of Liability

7.1 “As Is” Basis: The App and Services are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 No Financial Advice: Buckstrybe does not provide financial advice, credit advice, or recommendations. The information and tools provided (including the Credit Visibility Score) are for informational and facilitative purposes only. You should seek independent professional advice before making any financial decisions.

7.3 P2P Marketplace Disclaimer: * Buckstrybe explicitly disclaims any responsibility for the success or failure of P2P transactions between users. * We do not guarantee the solvency of any party in a P2P transaction or the repayment of any loans. * Any dispute arising from a P2P transaction is solely between the lending and borrowing parties, and Buckstrybe will not act as a mediator or enforcer.

7.4 Accuracy of Information: While we strive for accuracy, we do not warrant the completeness, security, reliability, quality, accuracy, or availability of the App or Services. We are not responsible for any errors or omissions, or for the results obtained from the use of this information.

7.5 Open Banking and Third Parties: We rely on third-party Open Banking providers for bank connectivity. While we choose reputable providers, we are not responsible for their service availability, security breaches on their systems, or any inaccuracies in the data provided by your bank through Open Banking.

7.6 Limitation of Liability: To the fullest extent permitted by law, in no event will Buckstrybe, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the App, any websites linked to it, any content on the App or such other websites, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, even if foreseeable.

7.7 Statutory Rights: Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. Your statutory rights as a consumer are not affected.

  1. Indemnification

You agree to defend, indemnify, and hold harmless Buckstrybe, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the App, including, but not limited to, your user contributions, any use of the App’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the App.

  1. Termination

9.1 By You: You may stop using the Services at any time. You can terminate your account by contacting our support team at support@buckstrybe.com.

9.2 By Us: We may terminate or suspend your access to all or part of the App and Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. We may also terminate or suspend accounts that have been inactive for a significant period.

9.3 Effect of Termination: Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

  1. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. You agree that any dispute arising from or relating to the subject matter of these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  1. Dispute Resolution

In the event of a dispute, we encourage you to contact us first at support@buckstrybe.com to seek an amicable resolution. We aim to resolve most disputes quickly and efficiently.

  1. Changes to These Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the App thereafter. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes. We will notify you of any material changes by posting the updated Terms on the App, sending you an email, or through other reasonable means.

  1. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

  1. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Buckstrybe regarding the App and Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.
